GENERAL TERMS AND CONDITIONS ONLINE SHOP TONIELLI VISION
These general terms and conditions of Tonielli Vision as a seller and you as a customer apply to all orders in the Tonielli Vision online shop (www.toniellivision.ch) as well as to those purchases for which Tonielli Vision declares these terms and conditions to be applicable.

The General Terms and Conditions apply to all services provided by Tonielli Vision in the online shop (www.toniellivision.ch) and become valid when a contract is concluded. The deliveries, services and offers from Tonielli Vision are made exclusively on the basis of these General Terms and Conditions, even if they are not expressly agreed again. By sending an order to Tonielli Vision, you confirm that you have read these General Terms and Conditions and expressly agree to them.
conclusion of a contract
All information about goods and prices during the ordering process is non-binding and subject to change. Sales contracts are concluded when Tonielli Vision accepts your order. Tonielli Vision will confirm acceptance of the order to you via email and is subsequently binding for you. Delivery delays will also be communicated to you as soon as possible by email. Delivery
You can choose to have your order shipped to an address of your choice.
The delivery of the goods is generally carried out via post (standard packages).
Since there is a single person behind Tonielli Vision and each individual product is printed and finished by hand, the delivery time can take between 3-15 working days, depending on demand. After your order has been handed over to the shipping service provider, we will send you a tracking number by email.
If an item in our range is not available, we will inform you as soon as possible via email. Tonielli Vision reserves the right to make a partial delivery if this appears to be beneficial for the efficient processing of the entire delivery. Of course, in such cases no additional shipping costs will be charged for subsequent delivery.

All prices on www.toniellivision.ch are exclusive of VAT (currently 8.1%) as required by law in Switzerland and include shipping costs. Tonielli Vision has the right to adjust the prices stated online at any time without notice and without further explanation. The time of the order on the website applies for the calculation of the prices.

Right of withdrawal/return
The customer is granted a right of withdrawal for 10 calendar days after receipt of the goods. This deadline is deemed to have been met if the customer sends the written withdrawal by email or letter (address as per imprint) to Tonielli Vision within the deadline. The withdrawal does not require any justification.
Exercising the right of withdrawal will result in the contract being reversed. The customer must return the goods in their original packaging, together with the delivery note, to the return address specified by Tonielli Vision in the imprint within 10 calendar days. Returns to Tonielli Vision are at the customer's expense and risk. Any payment already made will be refunded to the customer within 20 calendar days, provided that Tonielli Vision has already received the goods back or the customer can provide proof of shipment.
Tonielli Vision reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the loss in value from the purchase price already paid or to invoice the customer.
warranty
Tonielli Vision strives to deliver every single hand-printed and finished item of clothing in perfect quality. If defects are reported in a timely manner, Tonielli Vision guarantees that the item purchased by the customer is free of defects and functional during the warranty period, which is usually 6 months from the delivery date. It is in Tonielli Vision's interest to undertake repairs free of charge in the event of defects.
The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that are due to external circumstances.
Tonielli Vision is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it neither represents nor guarantees that the use of the website will not infringe the rights of third parties who are not owned by Tonielli Vision.
care/handling
Tonielli Vision assumes no liability for any improper care and/or handling of the delivered items by the customer. We therefore ask you to read the relevant instructions in the product description.
data protection
Tonielli Vision undertakes to process your customer data carefully and to observe the provisions of the relevant data protection legislation. In particular, no data will be passed on to third parties. Tonielli Vision uses suitable security technology to protect customer data against unauthorized processing. However, no liability can be accepted for the security of data transmitted over the Internet. The data is transmitted in encrypted form. You can find detailed information on data protection in our privacy policy.
liability in general
It is hereby expressly pointed out that no liability claims can be made against Tonielli Vision for indirect damage or consequential damage suffered by the customer, unless the damage was caused intentionally or through gross negligence by Tonielli Vision. In particular, damage resulting from accidents, etc. is your own responsibility.
change of terms and conditions
Tonielli Vision expressly reserves the right to unilaterally amend these General Terms and Conditions at any time without prior notice, particularly in the event of changes to the relevant legal provisions.
partial invalidity
Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Applicable Law/Jurisdiction
In any case, the relationship between you and Tonielli Vision is subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB).
